Authentic Japan Shunme services are provided by Yuko Okuhara, whose business names is Yukino Shunme, or SHUNMEYUKINO, located at 15-49 Nakataikoyama, Imizu City, Toyama Prefecture, 9390363, Japan.

By using this service, you agree to these terms and conditions. Please read them carefully.

Terms and Conditions 

Article 1  DIFINITIONS

1-1  “You” means you as an individual, or if applicable, the company or other legal entity you represent.

1-2  “AJ Shunme” means the business and its website named as Authentic Japan Shunme carried by Yukino Shunme.

1-3  “Service” means all the services, including provision of products, provided by Authentic Japan Shunme to Customers.

1-4  “Orders” means any order for Services created by You as a Customer, and accepted by Authentic Japan Shunme via an acknowledge in the platform where You can access the Service or otherwise in writing.

1-5  “Customers” means visitors to this website and any person who seeks to use the Services by ordering the Service provided in connection with the foregoing.

1-6  “Clients” as well as Customers means any person who orders and receives the Service.

1-7  “Website” means Authentic Japan Shunme’s website where You can access the Service and initiate Orders.

1-8  “Items” means products that are provided by Authentic Japan Shunme through the Website or any other means specified by Authentic 

Article 2  USING THE SERVICE 

2-1  Terms and conditions herein are of a legal agreement between You and AJ Shunme, which will apply to and in respect of any and all Services offered by or acquired from the AJ Shunme.  If You do not agree with the terms and conditions herein, You may not use the Service. You represent that You are 18 years of age, or of the age of majority in Your place of residence or jurisdiction.

2-2  The agreement in connection with the use of the Service shall be executed on receipt by AJ Shunme of the payment from Customer for the Service after AJ Shunme offers a quotation and Customer accepts it.

Article 3  ON THE SERVICE

3-1  You may request or order the Service through the means specified on Website only if you understand and acknowledge the contents and system of the Service.  AJ Shunme will offer the Service according to the contents of the quote provided by AJ Shunme and approved by the Customer.

3-2  AJ Shunme will make every reasonable effort to deliver (an) Item/s by the delivery date which should be informed by AJ Shunme in any means, and consented by the Customer in advance.  

3-3  Late delivery will not alter Customer’s obligation to pay all fees for the Service, provided that AJ Shunme made such effort set forth in the preceding paragraph.

3-4  Though the Service should be provided in good faith and on a best effort basis, due to the nature of Items that are handmade crafts made with natural materials, individual differences will inevitably occur. AJ Shunme shall not warrant that the Items categorized as the same products will be free from such differences.

3-5  AJ Shunme may determine at its sole discretion in any time for any reason, or no reason at all, the termination of the Service offering.

Article 4  ACCEPTANCE INSPECTION

4-1 The Customer shall verify whether or not (an) Item/s has/have any crack, or other flaws within a week of receipt. However, receiving (an) Item/s shall be deemed as completion of the Service with the exception as described in the next paragraph.

4-2 If the Customer finds any flaw as a result of the verification established in the previous paragraph, the Customer must notify AJ Shunme of the flaw within the period indicated in the previous paragraph. After receiving such notification, AJ Shunme will promptly take one of the following measures: repairing such Item/s, replacing it/them with the same Item/s, or refunding up to the list price.

4-3 If the Customer does not submit a notification of the flaw that was found within the period indicated in the paragraph previous to the last, the Service shall be deemed as completed at the end of this period. Request for repair, replacement, or refund will not be accepted after completion of the Service. In such a case, repair or replacement shall be a new request for fee-based services and refund will not be available.

Article 5  CONFIDENTIALITY

5-1 The Website must not leak, distribute, or publish to a third party any drafts, documents, or information provided with the purpose of an estimate or request. Any drafts, documents, or information shall only be viewed and used by AJ Shunme or any trustees that AJ Shunme has imposed the duty of confidentiality upon, and it shall be done within the scope necessary to complete the estimate or the requested Service.

5-2 If the Customer wishes to have a draft, document, or medium containing information that has been provided with the purpose of an estimate or Order to be returned or deleted, and the Customer make such a request to the Website or by mail, AJ Shunme will make every reasonable effort to respond to the request. 

Article 6  PRIVACY POLICY

6-1. The Website shall recognize the importance of personal information and observe the laws related to the protection of personal information.

6-2. The Website shall use the personal information which was collected for the purpose of giving quotations or fulfilling commissions, only for the purpose of giving quotations related to the Service or providing the Service.

6-3. The Website shall not use personal information for any purpose other than the scope of purpose set forth in the preceding paragraph.

6-4. The Website reserves the right to outsource work related to the handling of personal information within the scope necessary for the purposes set forth in the paragraph preceding the last.

6-5. The Website shall respond to inquiries from the Client regarding personal information to a reasonable extent after confirming the identity of the person in question.

Article 7  PRICING AND PAYMENT

7-1. Service fees related to the Service shall be as shown by AJ Shunme to the Customer on the Customer’s request, but, in some cases, shall be subject to change or increase at the discretion of the AJ Shunme, such as cases wherein the product/s ordered by the Customer are special or there are conditions that are not applicable to what is stated on the Website. If there is a change or addition to the said fees and the consent of the Customer cannot be obtained, the Service shall not be provided.

7-2 The payment methods for the service fees related to the Service shall be any one of the following: bank transfer to the Rakuten Bank account, the payment institution service of Payoneer or PayPal. The Customer shall pay for the service fees to place an order.

Article 8  CHANGING AND CANCELING COMMISSIONS

8-1. Because Items are not ready-made, once the contract relating to the use of the Service has been executed, making changes to the Order shall not be accepted. The use of the Service after the change that is approved by AJ Shunme for special reasons shall be treated as a new order.

8-2. As a general rule, for the same reason as stated in the previous paragraph, cancellations originating from the Client after the execution of the contract relating to the use of the Service will not be accepted.  However, if it happens, such cancellation shall result in a refund to the Client for a half amount of the total fees received by AJ Shunme after deducting the handling fees for refund.  The refund method in such cases shall be at the discretion of the Website. 

Article 9  RESPONSIBILITY OF THE CUSTOMER

9-1 The Website shall bear no responsibility for any result of, or any accident related to, the use, storage, or handling of the Item by the Customer, including, but not limited to, the result or the accident caused by the nature of Items that are handmade crafts made with natural materials.

9-2 The Customer shall judge the risk of any problem regarding to the use of the Item, including the allergic reaction caused by urushi or any other material with which Items are made of. Whether or not the Customer purchases the Item after judging the risk shall be left to the discretion of the Customer, which means the Customer shall bear all responsibility and cause no trouble to the Website.

9-3 The Customer may not carry out the following acts regarding usage of the Service.

A. Impersonation of others

B. Acts of falsifying a name regarding credit card information or deposit accounts for payments

Article 10  INDEMNIFICATION

10-1 Though the Service should be provided in good faith and on a best effort basis, the Website shall not guarantee the accuracy, completeness, usefulness of any description related to Items, their materials, and the Services. The Website shall bear no responsibility even if the Customer or a third party is subject to damages as a result of the corresponding description.

10-2 The Website shall take all possible measures for delivery but bear no responsibility even if delivery is hindered due to an unforeseen circumstance.

10-3 Shall the Customer be subject to direct damages for a cause attributable to the Website, the Website shall return the entirety or a portion of the service fees received from the corresponding Customer regarding the damage incurred directly and in reality.

Article 11  DISPUTE RESOLUTION

Any matters not addressed in these terms and conditions, or any doubt or uncertainty with respect to these terms and conditions, shall be determined or resolved through good faith consultation between You and AJ Shunme.

Article 12  GOVERNING LAW AND JURISDICTION

Terms and conditions herein are of a legal agreement between You and AJ Shunme and governed by and construed in accordance with the laws of Japan without regard to the principles of the conflict of laws thereof. And all disputes arising out of or in connection with this agreement shall submit to the exclusive jurisdiction of the Nagoya District Court or Takaoka Summery Court depending on the subject matter jurisdiction.

Article 13  LANGUAGE

If this English version does not conform to the Japanese version, the Japanese version shall prevail.

第１条【本サービス利用】

  1. 本利用規約は、ウェブサイト「Authentic Japan Shunme」および事業名「旬馬ゆきの」（両者をあわせて以下「本サイト」と記載）が提供する商品とそれに関わる業務（両者をあわせて以下「本サービス」と記載）の利用について規定するものです。本サービスを利用する方（以下「依頼者」）は、本利用規約にご同意いただくことによって、本サービスを利用することができます。
  2. 本サービスの利用に関わる契約（以下「本契約」といいます。）は、本サイトからお見積りを連絡した後に、依頼者が料金を支払い、本サイトが当該料金の受領を確認した時点で締結されたものとされます。

第２条【本サービスについて】

  1. 依頼者は、本サービスの内容および仕組みを理解・承諾の上、指定の方法にて依頼するものとします。本サイトは、依頼者に連絡したお見積書等に記載した内容で本サービスを提供します。
  2. 本サイトは、お約束した納品日までに商品をお届けすることに最善の努力をします。
  3. 本サイトが最善を尽くしたにもかかわらず、納品が遅れた場合でも、依頼者の料金の支払い義務は失われないものとします。
  4. 本サイトは、質の高い商品の提供にむけて最善の努力をしますが、商品は自然素材を生かした手作りのものであるため、同じ商品であっても個体差が生じます。
  5. 本サイトは、いかなる理由・時機であっても、その裁量により、本サービスの提供をとりやめることができるものとします。

第３条【検査】

  1. 依頼者は、本サービスのうち、商品を受領した日から1週間以内に、ひびなどの瑕疵がないかを検査するものとします。ただし、次項の場合を除き、サービスの完了は依頼者が商品を受領した時点とみなします。
  2. 依頼者は、前項に基づく検査の結果、明らかな瑕疵を発見した場合には、前項の期間内にその旨を本サイトに通知するものとします。本サイトは、当該の通知を受けた場合には、できるだけ速やかに当該瑕疵を修復するための措置、または、商品の交換、当該商品の販売価格を上限とする返金によって対応するものとします。
  3. 前項の期間内に依頼者が瑕疵を発見した旨を通知しなかった場合は、同期間の経過をもってサービスの完了とみなします。サービス完了後の返品・返金は受け付けません。ただし、商品の使用および使用による劣化および経年変化に関する相談は受け付けます。

第４条【秘密厳守】

  1. 本サイトは、お見積りまたはご依頼の目的で提供を受けた情報すべてについて第三者に漏洩、頒布、公開しないものとします。当該情報は、お見積りまたはご依頼の本サービスを完了する上で必要な範囲で本サイトまたは本サイトが守秘義務を課した受託者のみが閲覧、利用します。
  2. 本サイトは、お見積りまたはご依頼の目的で提供を受けた資料および情報を本サービスを提供する上で意図的に記録した媒体について、依頼者がご返却または削除を希望する場合には、現実的に可能な範囲でこれに対応します。

第５条【個人情報の保護および利用】

  1. 本サイトは、個人情報の重要性を認識し、個人情報の保護に関する法律を遵守するものとします。
  2. 本サイトは、お見積りまたはご依頼の目的で提供を受けた個人情報を、本サービスに関わる見積りまたは本サービスの提供の目的でのみ利用します。
  3. 本サイトは、前項に定める目的の範囲外の目的で個人情報を利用しません。
  4. 本サイトは、第2項に定める目的のために必要な範囲内で、個人情報の取扱いに関する業務を外部へ委託することがあります。
  5. 本サイトは、ご依頼者のご希望による個人情報の内容のご照会等に関して、ご本人であることを確認させていただいた上で、合理的な範囲で対応します。

第６条【料金の支払方法について】

  1. 本サービスに関わる料金は本サイトから依頼者に提示する内容に従うものとしますが、依頼内容の特殊性等に応じて、本サイトの裁量による変更・追加を伴うものとします。かかる変更・追加に関して依頼者の同意を得られない場合は、サービスの提供はしないものとします。
  2. 本サービスに関わる料金のお支払い方法は楽天銀行、Payoneer、PayPalが提供する送金サービスまたは決済サービスです。依頼者は、サービス料金を見積もりの有効期限内に支払うものとします。ただし、依頼者が有効期限の延長を申し出、かつ本サイトがそれを承諾した場合は、当該承諾の内容に従うものとします。

第７条【依頼内容の変更とキャンセルについての諸条件】

  1. 本サービスの利用に関わる契約締結後は、本サービスの体系上の理由から、依頼内容の変更は原則として受け付けないものとします。
  2. 本サービスの利用に関わる契約締結後に依頼者に起因してキャンセルが発生した場合、本サービスの体系上の理由から、依頼者への返金額は以下の通りとします：本サイトが依頼者から受領した金額の2分の1を本サイトが依頼者のキャンセルによって被る費用分として受領金額から差し引き、残りの2分の1から依頼者への返金に関わる手数料を差し引いた金額。尚、その場合の返金方法は本サイトの裁量によるものとします。

第８条【依頼者の責任】

  1. 商品が自然素材を使用していることに由来する結果・事故などを含み、依頼者による商品の使用・取り扱い・保管に関わるいかなる結果および事故に対しても、本サイトは一切の責任を負いません。
  2. 本サイトが提供する商品および商品に使用されている漆などの原材料・素材に対するアレルギー反応などの健康上の問題および精神上の問題および事故などについては、依頼者が当該問題および事故のリスクを購入前に判断するものとし、依頼者はすべての責任を引き受け、本サイトに一切の迷惑をかけないものとします。
  3. 依頼者は、本サービスの利用に関して、以下の行為を行ってはなりません。
  1. 他人へのなりすまし
  2. カード情報、貯金口座等の決済に関わる名義を偽る行為

第９条【免責】

  1. 本サイトは、誠意を以って商品の取り扱いの説明をしておりますが、その正確性、完全性、有用性を保証するものではありません。当該説明に起因する依頼者やその他第三者の損害についてはいかなる責任も負いません。
  2. 本サイトは、納品には万全を期しますが、予測不可能な事態による納品の遅延、阻害、停止に関し、本サイトは一切の責任を負いません。
  3. 本サイトの責めに帰すべき事由により依頼者が直接かつ現実的に損害を被った場合、本サイトは、かかる損害について、当該依頼者から受領した料金の全額または一部の返金を以って対応するものとします。

第１０条【協議】

本利用規約に定めのない事項や解釈に争いが生じたときは、本サイトと依頼者は、お互いに信義誠実の原則に則り、双方の協議によりその解決を図るものとします。

第１１条【準拠法および管轄裁判所】

本利用規約は、その抵触法の原則の適用を排除して、日本法に準拠して解釈されるものとします。本サービス利用に関して紛争が生じた際は、事物管轄に応じて名古屋地方裁判所ないしは高岡簡易裁判所を第一審の専属的管轄裁判所とします。

第１２条【言語】

本利用規約の日本語版と英語版との間に不一致がある場合、日本語版が優先されるものとします。
